Dada Boss Terms of Service EFFECTIVE DATE: 25/06/2025 Dada Boss (“We,” “Us,” or “Dada Boss”) operates an online platform (the “Website”). These Terms govern your use of the Website and purchases of products (“Products”) or services (“Services”) offered by Dada Boss. By accessing the Website, purchasing Products, or using Services, you agree to these Terms of Service (“Terms” or “Agreement”). This Agreement forms a legally binding contract between you and Dada Boss. Your use also constitutes consent to all applicable policies, including our Privacy Policy, Promotional Terms, and others posted on the Website. KEY UPDATES & CUSTOMIZATIONS Company Branding: Replaced prior company name references with "Dada Boss". All associated links and contact identifiers have been removed. Arbitration Agreement: Opt-out and general contact methods have been removed. Arbitration administrators include recognised organisations such as ADR Services and NAM. Governing law remains under California jurisdiction (specific county to be determined). Jurisdiction-Specific Clauses: The limitation of liability disclaimer excludes New Jersey as retained from the original template. Brand Alignment: All original references rebranded to Dada Boss throughout. CORE TERMS 1. User Obligations Users must be at least 18 years old or the legal age of majority in their jurisdiction. Users must provide accurate and truthful information. Misuse of the Website, including unauthorized access or account sharing, is prohibited. You are responsible for maintaining the confidentiality of your account details. 2. Purchases All purchases are subject to acceptance by Dada Boss. Purchasing for resale or wholesale distribution is not allowed. Prices and product availability may change without prior notice. Returns and exchanges are governed by the company's Return Policy. 3. Intellectual Property All content on the Website (including text, images, logos, and designs) is owned or licensed by Dada Boss. Dada Boss is not liable for indirect, incidental, or punitive damages, except as may be permitted by law, such as in New Jersey. ARBITRATION AGREEMENT Binding Individual Arbitration All disputes must be resolved through individual arbitration, not in court. Users waive their rights to participate in class action lawsuits and jury trials. Opting out of arbitration terms must be done within 30 days of agreement acceptance. Arbitration Process Users must first attempt to resolve issues informally within 60 days. Arbitration will be administered by an approved third-party arbitrator (e.g., ADR Services or NAM). For large-scale claims, batching may apply (20+ for ADR; 25+ for NAM). Governing Law & Venue The Federal Arbitration Act applies. If a dispute is not subject to arbitration, it will be resolved in courts within the specified state jurisdiction. OTHER PROVISIONS Severability: If any part of the Arbitration Agreement is found unenforceable, the remainder may also be deemed void. Survival: Arbitration and other legal provisions remain enforceable after account termination or agreement expiration. Amendments: Users may opt out of future changes to arbitration terms within 30 days of posting.
